Waterford Walks Waiver Form

Please read each of the following statements carefully.

In this waiver, the term “Waterford Walks” refers to an informal walking group organized by the Social Committee of the Waterford Place Homeowners Association, Inc., its members, directors, trustees, officers, employees, agents, volunteers, sponsors, representatives, and any persons or entities whose property may be used as part of the “Waterford Walks” activity.

Waiver:
In consideration of being permitted to participate in any way in the Waterford Walks community walking activity/event hereinafter called “Waterford Walks,” I, for myself, my heirs, personal representatives, or assigns, do hereby release, waiver, discharge, and covenant not to sue the Waterford Place Homeowners Association, Inc., its officers, employees, and agents for liability from any and all claims including the negligence of Waterford Place Homeowners Association, Inc., its officers, employees, and agents, resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in Waterford Walks.

Assumption of Risks:
Participation in Waterford Walks carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another.
 
I represent that I am in adequate physical condition to participate and that I have consulted my doctor or another healthcare provider as to any concerns I have regarding my ability to participate safely.

I understand that Waterford Walks cannot guarantee my safety while attending or participating in the activity. I understand that participation in the activity exposes me to certain risks, including the possibility of severe injury or death, from, but not limited to: traffic, falls and other hazards of walking in different settings, contact with animals, exposure to hazardous weather conditions, and the possibility of walk or weather related injury or illness.

I understand that any health-related information being given or discussed in a public venue is for general knowledge and is not intended to replace a personal consultation with my doctor or healthcare provider. I will consult my doctor or healthcare provider regarding personal health concerns.

I understand that it is my responsibility to protect my property while participating in Waterford Walks events and that Waterford Walks cannot be responsible for any damage to or loss of such property.

I grant permission to Waterford Walks and Waterford Place Homeowners Association, Inc. to use my name, any photographs, motion pictures, recordings, or any other record of my participation in the Waterford Walks activities for any legitimate purpose. I release any rights of privacy and/or compensation that I may have in connection with such use.

I have read the previous paragraphs, and I know, understand, and appreciate these and other risks that are inherent in Waterford Walks. Nevertheless, I hereby assert that my participation is voluntary and that I knowingly assume all such risks.

Indemnification and Hold Harmless:
In consideration for my taking part in Waterford Walks activities/events, I, for myself, my heirs, executors, administrators, successors, and assigns, release, waive, indemnify and hold harmless Waterford Walks and Waterford Place Homeowners Association, Inc. from any and all liability, claims, demands, damages, costs, actions and causes of action with respect to death, injury or property damage, however, caused, arising out of my participation in the Waterford Walks activities/events.

I also agree to indemnify and hold Waterford Place Homeowners Association, Inc. harmless from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in Waterford Walks and to reimburse Waterford Place Homeowners Association, Inc. for any such expenses incurred.

Severability:
I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms and conditions and understand that I am giving up substantial rights, including my right to sue/right to legal remedy. I acknowledge that I am signing the agreement freely and voluntarily. I intend, by my agreement below, this waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law.
